TERMINI E CONDIZIONI GENERALI PER GLI UTENTI DEL MARKETPLACE REZNA SHOP
1. Informazioni preliminari
REZNA di VALDIFIORI GIORGIO è una ditta individuale con sede in Forlì, Via del Bosco 42, CF VLDGRG83M14D704X e P.IVA 04562920407 pec: giorgio.valdifiori@legalmail.it
REZNA è un marchio di proprietà esclusiva di VALDIFIORI GIORGIO. REZNA è un marketplace di commercio elettronico (marketplace tematico) che offre agli utenti registrati la possibilità di fare offerte, vendere e acquistare oggetti rientranti in determinate categorie merceologiche. REZNA infatti tratta quasi esclusivamente oggetti usati appartenenti alle seguenti categorie: RICAMBI AUTO, RICAMBI MOTO, MEZZI DA LAVORO, AUTOMOBILIA, GIOCATTOLI D’EPOCA. REZNA non ha il possesso dei beni messi in vendita o venduti attraverso il marketplace, non trasferisce la proprietà degli oggetti dal VENDITORE al CLIENTE, non ha alcun ruolo e non è coinvolta nella compravendita che si svolge tra venditori e acquirenti. Il contratto che definisce l’acquisto si conclude direttamente tra gli acquirenti (CLIENTI) e i venditori. REZNA non rivede le inserzioni degli utenti o i contenuti e non offre alcuna garanzia circa la precisione ed affidabilità delle informazioni contenute e pubblicate sulle pagine degli utenti, né offre alcuna garanzia circa i risultati ottenuti tramite l’uso della piattaforma di marketplace, né il buon esito delle eventuali trattative intercorse tra gli utenti. REZNA non ha alcun controllo, non garantisce e non ha alcuna responsabilità in merito all’esistenza, la qualità, la sicurezza e la liceità degli oggetti pubblicizzati; la veridicità o l’accuratezza dei contenuti degli utenti, delle inserzioni e dei feedback; la capacità degli acquirenti di pagare il prezzo degli oggetti; la capacità degli utenti di vendere, acquistare e fare offerte. REZNA non può assicurare che un CLIENTE o un VENDITORE siano effettivamente in grado di portare a termine un affare, di consegnare o di restituire un oggetto.
2. Oggetto dell’accordo
REZNA ha ideato, progettato, e gestisce una piattaforma di marketplace di commercio elettronico (“marketplace rezna.shop”) che permette agli utenti registrati la possibilità di fare offerte, vendere e acquistare oggetti del tipo indicato al precedente punto 1. Per accedere alla piattaforma di marketplace è necessario che l’utente registri i propri dati o come CLIENTE e/o come VENDITORE sulla pagina di accesso della piattaforma, previa lettura dell’informativa e spunta del consenso, ove necessario.
3. Registrazione utenti, accettazione dell’accordo
I presenti Termini e Condizioni Generali si applicano al momento in cui l’utente si registra al sito mediante creazione di un nome utente (o email) e password. Con tale azione l’utente accetta i presenti Termini e Condizioni Generali e tutte le ulteriori regole, tariffe e servizi, collegati od accessori all’uso del proprio account. L’utente è tenuto a visionare preliminarmente l’Informativa Privacy per gli utenti e prestare il consenso al trattamento dei dati, se e come richiesto. Ogni eventuale modifica ai presenti Termini e Condizioni Generali viene pubblicata nella pagina home del sito www.rezna.shop inviata via email all’utente e inserita nella sezione degli Annunci dell’account utente (se venditore). Salvo quando diversamente specificato, le modifiche al presente accordo sono efficaci decorsi 30 (trenta) giorni dalla data di pubblicazione o comunicazione.
4. Comportamenti Vietati e Obblighi degli Utenti
I seguenti comportamenti messi in atto dagli utenti nell’uso della piattaforma di marketplace sono espressamente vietati:
- pubblicare contenuti od oggetti in una categoria o in sezioni non appropriate
- pubblicare dati falsi, inesatti, fuorvianti, diffamatori o calunniosi;
- violare la legge, i diritti altrui o le regole della piattaforma;
- vendere oggetti contraffatti;
- violare il diritto d’autore, il diritto di marchio od ogni altro diritto di privativa intellettuale o industriale di terzi;
- utilizzare i servizi della piattaforma di marketplace se non si ha la capacità di agire (ad es. concludere contratti legalmente vincolanti se sprovvisti della maggiore età, se sottoposti ad amministrazione di sostegno)
- utilizzare i servizi della piattaforma di marketplace se si è stati sospesi dall’accesso e dall’uso per qualsiasi motivo;
- non effettuare il pagamento degli oggetti acquistati, a meno che il VENDITORE non abbia modificato in maniera sostanziale la descrizione dell’oggetto dopo l’offerta, vi sia un evidente errore nell’annuncio, oppure non sia possibile contattare il VENDITORE;
- non consegnare gli oggetti venduti, a meno che il CLIENTE non rispetti le condizioni pubblicate nell’annuncio oppure non sia possibile contattare il CLIENTE;
- manipolare il prezzo degli oggetti o interferire con le inserzioni di altri utenti;
- utilizzare o pubblicare spamming, messaggi a catena o schemi di vendita piramidale;
- utilizzare le informazioni di contatto di altri utenti per finalità diverse dalla conclusione di una specifica transazione
- diffondere virus o qualsiasi altra tecnologia volta a danneggiare la piattaforma di marketplace oppure gli interessi o diritti di proprietà di altri utenti;
- utilizzare robot, spider, scraper o altri strumenti automatici per accedere alla piattaforma;
- violare qualsiasi restrizione relativa all’esclusione di utilizzo dei robot, se presente o successivamente introdotta, interferire con le funzionalità dei servizi offerti o effettuare un irragionevole e sproporzionato sovraccarico delle infrastrutture;
- copiare, riprodurre, effettuare reverse engineering, modificare, creare lavori derivati, distribuire o diffondere pubblicamente qualsiasi contenuto (di terzi) senza la preventiva autorizzazione di REZNA e dei soggetti terzi, ove applicabile;
- raccogliere in modo manuale o automatico o raccogliere in qualsiasi modo informazioni sugli utenti, compresi gli indirizzi email, senza il loro consenso;
Nel caso in cui l’utente abbia registrato un account da VENDITORE e non sia un consumatore, garantisce di avere l’autorità per rappresentare legalmente la società o l’impresa a cui è intestato l’account. Nel caso in cui l’utente utilizzi il marketplace per svolgere un’attività commerciale, è tenuto a conformarsi alla normativa applicabile relativa alle vendite online per il sito sul quale ha messo in vendita l’oggetto. In particolare l’utente professionale deve
REZNA offre i propri servizi all’utente dal momento della sua registrazione e conseguente accettazione dei TERMINI E CONDIZIONI GENERALI. Fatto salvo quanto qui previsto, visto l’art. 59 del Codice del Consumo, non è consentito l’esercizio del diritto di recesso dopo l’inizio della prestazione del servizio erogata. REZNA si riserva inoltre il diritto di cancellare account non confermati o account inattivi da molto tempo (ad esempio 12 mesi).
5. Responsabilità e doveri del VENDITORE
Il VENDITORE è il solo responsabile delle informazioni, dell’autenticità degli oggetti, della legittima fonte di provenienza, della liceità, della descrizione, dello stato e delle immagini relative, in conformità alle regole e disposizioni in base alle quali può essere limitata o vietata la vendita. Al momento del caricamento di un oggetto il VENDITORE deve descrivere lo stato dell’oggetto in modo dettagliato, esatto e corrispondente alla condizione effettiva dello stesso e indicare eventuali vizi, difetti, imperfezioni, usura e provenienza, deve indicare il metodo di consegna al CLIENTE e i costi di spedizione (ragionevoli e adeguati alla tipologia dell’oggetto), deve specificare i tempi di imballaggio e le regole sulla restituzione. Il VENDITORE a seguito della pubblicazione dell’annuncio è tenuto 1) a mantenere l’oggetto nel medesimo stato e alle stesse condizioni indicate nell’annuncio. 2) a segnalare nell’annuncio ogni eventuale circostanza che possa compromettere o impedire la vendita 3) a monitorare con costanza i propri annunci 4) provvedere all’immediata rimozione in caso di indisponibilità degli oggetti messi in vendita, 5) a rimborsare al CLIENTE in caso di difetti occulti dell’oggetto 6) ad accettare il pagamento con il metodo prescelto dal CLIENTE 7) in caso di conferma dell’ordine da parte del CLIENTE, curare la spedizione conformemente alle indicazioni inserite nell’annuncio e mettere in grado il CLIENTE di tracciare il servizio. REZNA non garantisce che la pubblicazione dell’annuncio avvenga immediatamente. Gli annunci che contengono oggetti o contenuti che violano le regole della piattaforma di marketplace saranno rimossi o modificati a insindacabile giudizio di REZNA.
6. Responsabilità e doveri del CLIENTE
Il CLIENTE deve leggere l’intero annuncio con attenzione prima di procedere all’acquisto (o fare un’offerta). Il CLIENTE dichiara e si impegna a concludere con il VENDITORE un contratto di vendita valido e vincolante. S’impegna altresì a pagare il prezzo dell’oggetto con il metodo di pagamento prescelto. Non è consentito al CLIENTE: 1) indicare un indirizzo diverso da quello specificato nel modulo di pagamento; 2) richiedere servizi di spedizione non offerti dal VENDITORE; 3) posticipare la spedizione dell’oggetto per pagarlo più tardi; 4) chiedere o esigere un rimborso parziale o totale senza prima aver indicato i motivi della richiesta e aver restituito l’oggetto al VENDITORE; 5) chiedere oggetti o servizi diversi da quelli pubblicati nell’annuncio; 6) completare l’acquisto fuori dalla piattaforma.
7. Servizi di pagamento
Il CLIENTE può utilizzare il sistema di pagamento on line in moneta elettronica offerto da REZNA, anche qualora si tratti di servizi di terze parti abilitati dalla piattaforma, tra i quali sono compresi anche le opzioni che consentono la dilazione di pagamento o servizi assimilabili, regolati dai termini e condizioni del fornitore selezionato. Tali sistemi di pagamento utilizzano protocolli di sicurezza in grado di garantire la privacy e l’affidabilità delle transazioni finanziarie. Le informazioni complete relative ai dati del sistema di pagamento prescelto (ad es. carta di credito) non saranno mai memorizzate, nemmeno in forma temporanea, da REZNA e saranno utilizzate esclusivamente per perfezionare l’operazione di acquisto, di eventuale rimborso ove necessario o per segnalazioni alle forze dell’ordine di eventuali frodi commesse nell’uso della piattaforma. Eventuali problematiche riferite al sistema di pagamento potranno essere contestate esclusivamente al gestore del sistema di pagamento (ad esempio PayPal) e non a REZNA.
8. Tariffe per la Pubblicazione degli Annunci e Commissioni di Vendita
La pubblicazione degli annunci di vendita è regolata dalle seguenti tariffe, suddivise in base al valore dell’oggetto pubblicato:

REZNA applica una commissione del 5% (cinquepercento) sul prezzo finale di vendita esposto al CLIENTE. Per prezzo finale s’intende il prezzo dell’oggetto aumentato dei costi per IVA se dovuta, per l’imballaggio e la consegna (trasporto) al CLIENTE. La commissione è incamerata da REZNA al momento del pagamento effettuato sulla piattaforma. REZNA si riserva il diritto di modificare tariffe e commissioni. In tal caso comunicherà via email o pec all’utente le modifiche proposte. Le modifiche saranno effettive decorsi 15 giorni dalla comunicazione. L’Utente, nel caso non volesse accettare i nuovi importi è libero di recedere dall’accordo. La mancata risposta equivale ad accettazione delle modifiche contrattuali.
9. Risoluzione e Recesso
In caso di inadempimento da parte dell’Utente ai presenti Termini e Condizioni Generali REZNA invierà formale diffida ad adempiere nel termine non inferiore a 15 giorni. Nel caso in cui l’Utente non provveda nel termine e nei modi indicati nella diffida REZNA potrà risolvere il presente accordo. In ogni caso REZNA, a seguito della diffida, previa comunicazione potrà sospendere, limitare o interrompere i propri servizi e/o l’accesso all’account dell’Utente, limitare, modificare, oscurare, cancellare o rimuovere anche solo parzialmente gli annunci, impedire l’accesso al profilo o l’utilizzo di qualsiasi altro servizi, cancellare ogni altri contenuto pubblicato dall’Utente, adottando ogni provvedimento tecnico e legale per impedire all’Utente di utilizzare la piattaforma.
L’Utente che intende recedere dal presente accordo è tenuto ad inviare una comunicazione via pec od equivalente. Il recesso avrà effetto decorsi 60 giorni dal ricevimento della comunicazione. A seguito dell’intervenuto recesso REZNA provvederà a cancellare l’account dell’utente, nonché a rimuovere qualsiasi indicazione correlata agli annunci, allo stato e al profilo dell’Utente.
Resta salvo il diritto di REZNA di conservare, per un periodo massimo di 10 anni, nei propri archivi digitali una copia dell’account dell’utente, dei contenuti e del profilo ai fini di ogni eventuale tutela giudiziaria ovvero per la corretta tenuta delle contabilità (v. anche Informativa Privacy).
10. Resi e Restituzioni
Il VENDITORE è tenuto a informare il CLIENTE delle politiche sui resi, sulle modalità e i costi di restituzioni degli oggetti (il costo di restituzione, se non diversamente stabilito è generalmente a carico del CLIENTE, anche consumatore. In ogni caso il VENDITORE, se professionista, è tenuto a garantire al CLIENTE consumatore la possibilità di esercitare il diritto di recesso e di restituire l’oggetto acquistato nei termini e con le modalità previste dal D. Lgs. 6 settembre 2005, n. 206, se ed in quanto applicabili.
11. Limitazioni di Responsabilità
REZNA, in qualità di gestore tecnico-operativo della Piattaforma, si impegna a fare tutto quanto nelle proprie capacità e competenze al fine di garantire l’accesso ai servizi. REZNA non è responsabile verso il Venditore né verso il Cliente o i terzi in caso di ritardi, malfunzionamenti, e/o interruzioni dell’attività della piattaforma di marketplace o nella prestazione dei servizi causati da a) forza maggiore o caso fortuito; b) interruzione della erogazione del servizio di energia elettrica; c) mancanza di connettività, errori del software, hardware failure, problemi con i database, malfunzionamenti, mancata erogazione delle pagine e/o delle immagini, errori negli algoritmi, e in genere, qualsiasi malfunzionamento della piattaforma di marketplace che non sia imputabili a dolo e/o colpa grave o che siano imputabili a fatto del terzo, compresi eventuali fornitori di cui REZNA si avvale. È forza maggiore a titolo esemplificativo e non esaustivo un evento come lo sciopero, la serrata, la rivolta, la guerra, l’invasione, i provvedimenti governativi, l’attacco informatico, ovvero eventi naturali quali incendi, esplosioni, alluvioni, inondazioni, esondazioni, terremoti, maremoti, epidemie e/o altre calamità naturali. REZNA non è responsabile per danni compensativi, incidentali, diretti, indiretti, speciali, punitivi o consequenziali, né per perdite di utilizzo, perdite di dati, o danni alle proprietà, reclami di terze parti, perdite causate ai contenuti, alle informazioni, o ai prodotti pubblicati negli annunci oppure per errori, omissioni, interruzioni, comunicazioni errate, eliminazioni di file o email, problemi, difetti, virus, troians, ritardi nel funzionamento o nella trasmissione o qualsiasi altro problema di prestazione, furto, distruzione o accesso non autorizzato a database, o altre perdite di qualsiasi tipo o carattere correlate all’utilizzo della piattaforma. L’Utente si assume la responsabilità completa in merito all’adozione di procedure relative al backup dei proprio account e al controllo dei propri sistemi informatici. Ove mai dovesse essere accertata una qualsiasi responsabilità in capo a REZNA per la mancata e/o la ritardata esecuzione dei servizi connessi alla piattaforma, REZNA risponderà nei confronti dell’Utente unicamente dei danni diretti e prevedibili, ed entro il limite massimo di un importo pari alla commissione se e come incamerata (v. Tariffe) ed applicata alla transazione dell’oggetto venduto. In ogni caso REZNA non risponde dei danni correlati ad un evento, se sono trascorsi più di 12 mesi.
12. Contenuti forniti dagli Utenti
L’utente si impegna ad assicurare che il contenuto (foto, testo, marchi o altro) direttamente associato ai propri annunci sia accurato nonché di avere la libera disponibilità all’uso di immagini, testi od ogni altro contenuto. L’utente è invitato a creare contenuti (foto e testi) originali. Con la pubblicazione dell’annuncio l’utente concede REZNA, a titolo gratuito, con riferimento a tutti i paesi del mondo, il diritto, non esclusivo, di usare, riprodurre, pubblicare, visualizzare, distribuire, adattare, modificare, riformattare, elaborare, e comunque sfruttare a fini commerciali o non commerciali, nonché di concedere in sub-licenza, tutti i contenuti (immagini del prodotto, descrizione del prodotto, altro tipo di testo) immessi e caricati nell’inserzione o nel profilo dell’account, ivi compresi i propri marchi o segni distintivi, seppur limitatamente alle finalità di cui al presente accordo. REZNA potrà continuare a utilizzare tali contenuti anche dopo lo scioglimento, per qualsiasi causa del presente accordo. Fermo restando quanto sopra detto, REZNA non può alterare i marchi o i segni distintivi dell’utente, se non al solo scopo di adattarli nella misura che si renda necessaria al loro utilizzo e alla loro pubblicazione e visualizzazione sulle pagine della piattaforma di marketplace. L’utente dichiara e garantisce di avere la disponibilità di tutti i diritti attinenti all’uso del marchio suo proprio o di altri segni distintivi in relazione a tutti i paesi dell’Unione Europea e che, fatta eccezione per i diritti suoi propri, in base alla normativa applicabile o in forza di un valido titolo giuridico conclusi con altri, non esistono divieti e/o limitazioni al diritto di riprodurre, pubblicare, visualizzare, distribuire, adattare, modificare, riformattare, elaborare, creare opere derivate, e comunque sfruttare, a fini commerciali o non commerciali, nonché concedere in sub-licenza, i contenuti e/o i marchi immessi o pubblicati dall’utente. L’utente si impegna sin d’ora a manlevare e tenere indenne RENZA da qualsiasi pretesa, richiesta di rimborso e/o risarcimento e/o danno e/o azione che qualsiasi terzo dovesse avanzare con riferimento ai marchi dell’utente e/o a qualsiasi contenuto pubblicato dall’utente sulla piattaforma.
13. Risoluzione delle controversie e Foro competente
Il presente accordo (Termini e Condizioni Generali) è regolato dalla legge italiana. Qualsiasi controversia relativa all’applicazione o interpretazione del presente accordo è di competenza esclusiva del Tribunale di Forlì, fatto salvo il diritto dell’utente se qualificabile come consumatore di adire il Foro del proprio luogo di residenza o domicilio. In caso di controversia tra REZNA e l’utente si consiglia l’utente di mettersi in contatto direttamente con il Titolare o l’Assistenza clienti per cercare una soluzione bonaria. REZNA prenderà in considerazione le richieste degli utenti che appaiano ragionevoli e fondate e tenterà di risolvere la controversia anche mediante procedure alternative alla via giudiziale, come la mediazione, la negoziazione assistita o l’arbitrato. La Commissione Europea mette a disposizione dei consumatori una piattaforma per la Risoluzione delle Controversie Online per risolvere le controversie in via stragiudiziale (Art. 14, par. 1 del Regolamento UE 524/2013). REZNA is a trademark exclusively owned by VALDIFIORI GIORGIO. REZNA is an e-commerce marketplace (thematic marketplace) that offers registered users the ability to make offers, sell, and purchase items belonging to specific product categories. REZNA deals almost exclusively in second-hand goods belonging to the following categories: AUTO SPARE PARTS, MOTORCYCLE SPARE PARTS, WORK VEHICLES, AUTOMOBILIA, VINTAGE TOYS. REZNA does not hold possession of the goods listed for sale or sold through the marketplace, does not transfer ownership of items from the SELLER to the CUSTOMER, and has no role in or involvement with transactions carried out between sellers and buyers. The purchase agreement is concluded directly between buyers (CUSTOMERS) and sellers. REZNA does not review user listings or content and offers no guarantee regarding the accuracy or reliability of information contained in or published on user pages, nor does it guarantee the results obtained through the use of the marketplace platform, nor the successful outcome of any negotiations between users. REZNA has no control over, does not guarantee, and bears no responsibility for: the existence, quality, safety, and legality of advertised items; the truthfulness or accuracy of user content, listings, and feedback; the ability of buyers to pay for items; or the ability of users to sell, purchase, or make offers. REZNA cannot ensure that a CUSTOMER or SELLER will actually be able to complete a transaction, deliver, or return an item.
Subject Matter of the Agreement
REZNA has conceived, designed, and manages an e-commerce marketplace platform (“rezna.shop marketplace”) that allows registered users to make offers, sell, and purchase items of the type described in Section 1 above. To access the marketplace platform, users must register their details either as a CUSTOMER and/or as a SELLER on the platform’s login page, after reading the privacy notice and providing consent where required.
User Registration, Acceptance of the Agreement
These General Terms and Conditions apply from the moment the user registers on the site by creating a username (or email) and password. By doing so, the user accepts these General Terms and Conditions and all additional rules, fees, and services connected to or ancillary to the use of their account. The user is required to read the User Privacy Policy in advance and provide consent to data processing, if and as required. Any amendments to these General Terms and Conditions will be published on the homepage of www.rezna.shop, sent to the user by email, and included in the Listings section of the user account (if the user is a seller). Unless otherwise specified, changes to this agreement become effective 30 (thirty) days after the date of publication or notification.
Prohibited Conduct and User Obligations
The following actions by users on the marketplace platform are expressly prohibited:
- posting content or items in an inappropriate category or section;
- posting false, inaccurate, misleading, defamatory, or slanderous information;
- violating the law, the rights of others, or the platform’s rules;
- selling counterfeit items;
- infringing copyright, trademark rights, or any other intellectual or industrial property rights of third parties;
- using the marketplace platform’s services without legal capacity to act (e.g., entering into legally binding contracts without being of legal age, or being subject to a support administration order);
- using the marketplace platform’s services if access has been suspended for any reason;
- failing to pay for purchased items, unless the SELLER has substantially altered the item’s description after the offer was made, there is an obvious error in the listing, or it is not possible to contact the SELLER;
- failing to deliver sold items, unless the CUSTOMER does not comply with the conditions published in the listing or it is not possible to contact the CUSTOMER;
- manipulating item prices or interfering with other users’ listings;
- using or posting spam, chain messages, or pyramid selling schemes;
- using other users’ contact information for purposes other than completing a specific transaction;
- spreading viruses or any other technology designed to damage the marketplace platform or the interests or property rights of other users;
- using robots, spiders, scrapers, or other automated tools to access the platform;
- violating any robot exclusion restrictions, whether currently in place or subsequently introduced, interfering with the functionality of the services offered, or placing an unreasonable and disproportionate load on the infrastructure;
- copying, reproducing, reverse engineering, modifying, creating derivative works from, distributing, or publicly disseminating any (third-party) content without the prior authorisation of REZNA and the relevant third parties, where applicable;
- manually or automatically collecting user information, including email addresses, without their consent.
Where the user has registered a SELLER account and is not a consumer, they guarantee that they have the authority to legally represent the company or business to which the account is registered. Where the user uses the marketplace to conduct commercial activities, they must comply with applicable regulations relating to online sales on the site on which they have listed the item. In particular, professional users must:
REZNA provides its services to the user from the moment of registration and subsequent acceptance of the GENERAL TERMS AND CONDITIONS. Subject to the provisions herein and pursuant to Article 59 of the Consumer Code, the right of withdrawal may not be exercised after the commencement of service delivery. REZNA also reserves the right to delete unconfirmed accounts or accounts that have been inactive for a long time (e.g., 12 months).
Responsibilities and Duties of the SELLER
The SELLER is solely responsible for the information provided, the authenticity of items, their legitimate origin, lawfulness, description, condition, and related images, in accordance with the rules and provisions under which the sale may be restricted or prohibited. When uploading an item, the SELLER must describe its condition in detail, accurately, and in a manner consistent with the item’s actual state, disclosing any defects, faults, imperfections, wear, and provenance. The SELLER must also indicate the delivery method to the CUSTOMER and shipping costs (which must be reasonable and appropriate to the type of item), specify packaging times, and set out return policies. Following publication of the listing, the SELLER is required to: 1) keep the item in the same condition as described in the listing; 2) notify the listing of any circumstances that may compromise or prevent the sale; 3) regularly monitor their own listings; 4) immediately remove any items that become unavailable; 5) refund the CUSTOMER in the event of hidden defects; 6) accept payment using the method chosen by the CUSTOMER; 7) upon confirmation of the order by the CUSTOMER, arrange shipment in accordance with the details set out in the listing and enable the CUSTOMER to track the service. REZNA does not guarantee that a listing will be published immediately. Listings containing items or content that violate the platform’s rules will be removed or modified at the sole discretion of REZNA.
Responsibilities and Duties of the CUSTOMER
The CUSTOMER must read the full listing carefully before proceeding with a purchase (or making an offer). The CUSTOMER declares and undertakes to enter into a valid and binding sales contract with the SELLER. The CUSTOMER also undertakes to pay the price of the item using the chosen payment method. The CUSTOMER is not permitted to: 1) provide an address different from the one specified in the payment form; 2) request shipping services not offered by the SELLER; 3) delay shipment of the item in order to pay later; 4) request a partial or full refund without first providing reasons for the request and returning the item to the SELLER; 5) request items or services other than those published in the listing; 6) complete the purchase outside of the platform.
Payment Services
The CUSTOMER may use the online electronic payment system offered by REZNA, including third-party services enabled by the platform, which may include deferred payment options or similar arrangements governed by the terms and conditions of the selected provider. These payment systems use security protocols designed to ensure the privacy and reliability of financial transactions. Complete information relating to the chosen payment method (e.g., credit card details) will never be stored by REZNA, even temporarily, and will be used solely to complete the purchase transaction, to process any refund where necessary, or to report any fraud committed on the platform to law enforcement authorities. Any issues relating to the payment system may only be disputed with the payment system provider (e.g., PayPal) and not with REZNA.
Listing Fees and Sales Commissions
The publication of sales listings is governed by the following fees, based on the value of the listed item:

REZNA charges a commission of 5% (five percent) on the final sale price shown to the CUSTOMER. The final price is defined as the item price inclusive of any applicable VAT, packaging, and delivery (shipping) costs to the CUSTOMER. The commission is collected by REZNA at the time of payment on the platform. REZNA reserves the right to modify fees and commissions. In such cases, it will notify the user of the proposed changes by email or certified email (PEC). Changes will take effect 15 days after notification. The User, if they do not wish to accept the new amounts, is free to withdraw from the agreement. Failure to respond shall be deemed acceptance of the contractual changes.
Termination and Withdrawal
In the event of a breach of these General Terms and Conditions by the User, REZNA will issue a formal notice to remedy the breach within a period of no less than 15 days. If the User fails to comply within the period and in the manner set out in the notice, REZNA may terminate this agreement. In any event, following the notice and prior written communication, REZNA may suspend, restrict, or discontinue its services and/or access to the User’s account, restrict, modify, hide, delete, or partially remove listings, prevent access to the profile or the use of any other services, delete any other content published by the User, and take any technical and legal measures to prevent the User from using the platform.
A User wishing to withdraw from this agreement must send a communication by certified email (PEC) or equivalent means. Withdrawal will take effect 60 days after receipt of the communication. Following withdrawal, REZNA will delete the user’s account and remove any information related to the user’s listings, status, and profile.
REZNA retains the right to keep, for a maximum period of 10 years, a copy of the user’s account, content, and profile in its digital archives for the purposes of any potential legal proceedings or for proper accounting records (see also Privacy Policy).
Returns and Refunds
The SELLER is required to inform the CUSTOMER of the return policy, the procedures, and the costs of returning items (return costs, unless otherwise agreed, are generally borne by the CUSTOMER, including consumers). In any event, where the SELLER is a professional, they are required to guarantee the CUSTOMER/consumer the right to exercise the right of withdrawal and to return the purchased item within the terms and in the manner provided for by Legislative Decree No. 206 of 6 September 2005, where applicable.
Limitations of Liability
REZNA, as the technical and operational manager of the Platform, undertakes to do everything within its power and competence to ensure access to its services. REZNA is not liable to the Seller, the Customer, or third parties for delays, malfunctions, and/or interruptions to the marketplace platform’s activity or service provision caused by: a) force majeure or fortuitous events; b) interruption of the electricity supply; c) lack of connectivity, software errors, hardware failures, database problems, malfunctions, failure to deliver pages and/or images, algorithm errors, or, in general, any malfunction of the marketplace platform that is not attributable to wilful misconduct and/or gross negligence, or that is attributable to acts of third parties, including any suppliers engaged by REZNA. Force majeure includes, by way of example and without limitation, events such as strikes, lockouts, riots, war, invasion, government measures, cyber attacks, or natural events such as fires, explosions, floods, inundations, overflows, earthquakes, tsunamis, epidemics, and/or other natural disasters. REZNA is not liable for compensatory, incidental, direct, indirect, special, punitive, or consequential damages, nor for loss of use, data loss, property damage, third-party claims, losses caused to content, information, or products published in listings, or for errors, omissions, interruptions, miscommunications, deletions of files or emails, issues, defects, viruses, trojans, delays in operation or transmission, or any other performance issue, theft, destruction, or unauthorised access to databases, or any other losses of any kind or nature related to the use of the platform. The User assumes full responsibility for implementing backup procedures for their account and for monitoring their own IT systems. Should any liability on the part of REZNA be established for the failure to perform or delayed performance of services connected to the platform, REZNA shall be liable to the User solely for direct and foreseeable damages, up to a maximum amount equal to the commission collected (if applicable, see Fees) in connection with the transaction involving the sold item. In any event, REZNA shall not be liable for damages relating to an event if more than 12 months have elapsed since that event occurred.
User-Generated Content
The user undertakes to ensure that any content (photos, text, trademarks, or other material) directly associated with their listings is accurate and that they have the unrestricted right to use images, texts, or any other content. Users are encouraged to create original content (photos and text). By publishing a listing, the user grants REZNA, on a royalty-free basis and with worldwide scope, a non-exclusive right to use, reproduce, publish, display, distribute, adapt, modify, reformat, process, and otherwise exploit for commercial or non-commercial purposes, as well as to sub-license, all content (product images, product descriptions, and other text) entered and uploaded in the listing or in the account profile, including their own trademarks or distinctive signs, solely for the purposes of this agreement. REZNA may continue to use such content after the termination of this agreement for any reason. Without prejudice to the foregoing, REZNA may not alter the user’s trademarks or distinctive signs, except for the sole purpose of adapting them to the extent necessary for their use and for publication and display on the marketplace platform’s pages. The user declares and warrants that they hold all rights pertaining to the use of their own trademark or other distinctive signs in relation to all countries of the European Union, and that, with the exception of their own rights arising under applicable law or under a valid legal title concluded with third parties, there are no prohibitions and/or restrictions on the right to reproduce, publish, display, distribute, adapt, modify, reformat, process, create derivative works, and otherwise exploit, for commercial or non-commercial purposes, or to sub-license, the content and/or trademarks entered or published by the user. The user hereby undertakes to indemnify and hold REZNA harmless from any claim, request for reimbursement and/or compensation and/or damages and/or action that any third party may bring with regard to the user’s trademarks and/or any content published by the user on the platform.
Dispute Resolution and Competent Court
This agreement (General Terms and Conditions) is governed by Italian law. Any dispute relating to the application or interpretation of this agreement falls under the exclusive jurisdiction of the Court of Forlì, without prejudice to the right of users qualifying as consumers to bring proceedings before the court of their place of residence or domicile. In the event of a dispute between REZNA and the user, the user is advised to contact the Owner or Customer Support directly in order to seek an amicable resolution. REZNA will consider user requests that appear reasonable and well-founded and will attempt to resolve the dispute also through alternative dispute resolution procedures, such as mediation, assisted negotiation, or arbitration. The European Commission provides consumers with an Online Dispute Resolution platform for resolving disputes out of court (Art. 14, para. 1 of EU Regulation 524/2013).
